For purposes of this Privacy Policy, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, financing applicant, co-applicant or guarantor, or another individual whose information we have collected pursuant to this Privacy Policy.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access any of the Services.
Accountability and Privacy Officer
EZ Rides is responsible for personal information under its control and has designated a Privacy Officer who oversees our compliance with this Privacy Policy and applicable privacy laws. You can contact our Privacy Officer using the details in the Contact section below.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on the Site, update the "Last updated" date, and take any other steps required by applicable law.
How We Collect and Use Your Personal Information
To provide the Services, we collect and have collected over the past 12 months personal information about you from a variety of sources, as set out below. The information that we collect and use varies depending on how you interact with us.
In addition to the specific uses set out below, we may use information we collect about you to communicate with you, provide or improve the Services, comply with any applicable legal obligations, enforce any applicable terms of service, and to protect or defend the Services, our rights, and the rights of our users or others.
What Personal Information We Collect
Information We Collect Directly from You
Information that you directly submit to us through our Services, online or at our retail locations, may include:
- Contact details including your name, address, phone number, and email.
- Order information including your name, billing address, shipping address, payment confirmation, email address, and phone number for order updates or SMS notifications.
- Account information including your username, password, security questions, and other information used for account security purposes.
- Financing information including the personal and financial details you provide when you apply for financing — such as your name, date of birth, identification and address history, employment and income information, and other financial information necessary to assess your application. Providing your Social Insurance Number (SIN) is optional; where you choose to provide it, we use it only to help verify your identity and locate your credit file. If a co-applicant or guarantor ("co-signer") is added to your application, we also collect that person's personal and financial information, with their consent. See the Financing and Credit Applications section below.
- Customer support information including the information you choose to include in communications with us.
Phone Numbers and SMS: If you provide your phone number, we may use it to send transactional updates (such as order and delivery notifications), customer-service messages, and, where you have opted in, marketing messages, SMS reminders, and abandoned-cart notifications. You may opt out of receiving SMS messages at any time by replying STOP.
We do not share SMS opt-in data or consent with any non-affiliated third parties.
Information We Collect About Your Usage
We may automatically collect certain information about your interaction with the Services ("Usage Data") through cookies, pixels, and similar technologies ("Cookies"). Usage Data may include device information, browser information, IP address, and information about how you interact with the Site.
Abandoned Cart Tracking: EZ Rides's website uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart-reminder messages via SMS, where permissible and only to users who have opted in.
Information We Obtain from Third Parties
We may obtain information about you from third parties such as:
- Companies who support our Site and Services, such as Shopify.
- Payment processors.
- Consumer credit reporting agencies, in connection with financing applications (including the results of credit inquiries).
- Finance and lending partners, in connection with the assessment of your financing application.
- Service providers who use cookies or pixels to collect information on our behalf for analytics, advertising, and service functionality.
Any information we obtain from third parties will be treated in accordance with this Privacy Policy.
How We Use Your Personal Information
Providing Products and Services
We use personal information to fulfill orders, process payments, send account or order notifications (including SMS, where applicable), facilitate shipping, process returns, register and administer warranties, manage accounts, and process and assess financing applications.
Marketing and Advertising
We may send you marketing emails and SMS messages and serve you advertising. We send commercial electronic messages either with your express consent or on the basis of an existing business relationship permitted under Canada's Anti-Spam Legislation (CASL) — for example, where you have made a purchase or inquiry within the periods allowed by CASL. Every marketing email and SMS identifies us and includes a way to unsubscribe, and you may opt out at any time (including by replying STOP to SMS). We honour opt-out requests promptly and within the timeframes required by law.
Security and Fraud Prevention
We use personal information to detect and prevent fraudulent, illegal, or malicious activity, and to verify identity.
Communication and Service Improvement
We use personal information to provide customer support and improve our Services.
Financing and Credit Applications
When you apply for financing through EZ Rides, online or at one of our retail locations, we collect the personal and financial information needed to verify your identity and assess your application, and we use and disclose that information as described below. We collect, use, and disclose this information with your consent, which you provide when you submit your application.
Credit inquiries. As part of assessing your application, we and our finance and lending partners may obtain one or more inquiries from consumer credit reporting agencies. Depending on the lender and the portal through which your application is processed, these inquiries may include hard inquiries, which can affect your credit score. In some cases, third parties will be able to see that you have applied for or obtained credit, which may affect your credit standing with them.
Sharing with finance and lending partners. To assess your application and identify approval options, we disclose your personal and financial information — including the results of any credit inquiries — to our finance and lending partners. These partners use your information to evaluate your application in accordance with their own privacy practices.
Automated decisions. Your application may be approved or declined through automated processing of the information you provide together with the results of credit checks and identity verification. This automated assessment is generally carried out by our finance and lending partners. Where an application is declined or only conditionally approved, a co-applicant or guarantor ("co-signer") may be added, in which case we collect and share that person's information as part of a reassessment, and that person must provide their own consent. If you are a Quebec resident and a decision about you is based exclusively on automated processing, you may request to be informed of that fact and of the personal information used to make the decision, and you may request that the decision be reviewed by the party that made it.
Social Insurance Number. Providing your SIN is optional. Where you choose to provide it, we use it only to verify your identity and to help locate your credit file with consumer reporting agencies.
Electronic delivery. The financing application is an electronic-only product. By submitting an application, you agree to our Electronic Consent Agreement and consent to receive all related documents, disclosures, and statements electronically.
Withdrawing consent. You may withdraw your consent at any time by contacting our Privacy Officer, subject to legal and contractual restrictions. Withdrawing consent does not affect information already shared with, or processed by, our finance and lending partners, and may prevent us from processing or continuing your application.
Cookies
We use Cookies to operate and improve the Site, understand user behavior, perform analytics, and tailor advertisements.
For specific information about Shopify Cookies, see Shopify's Cookie Policy.
Most browsers accept Cookies by default, but you may remove or block them through your browser settings.
Our website also recognizes the Global Privacy Control (GPC) signal for applicable opt-out requests.
For interest-based (online behavioural) advertising, you can opt out through the Digital Advertising Alliance of Canada's AdChoices program at youradchoices.ca. Where required by applicable law — for example, for Quebec residents — we do not activate advertising or tracking cookies without your consent.
Location Tracking and Location-Based Services
If you enable location-based features or if your device or browser provides location data (such as IP-based geolocation), we may collect and use this information to:
- Personalize your shopping experience
- Display region-specific products, pricing, or availability
- Prevent fraud
- Improve site analytics and performance
We do not collect precise GPS-level location data unless you explicitly grant permission through your device settings.
How We Disclose Personal Information
We may disclose personal information to:
- Vendors performing services on our behalf
- Finance and lending partners and consumer credit reporting agencies, in connection with financing applications
- Business and marketing partners
- Affiliates
- During business transactions such as mergers or asset transfers
- When required by law
SMS Opt-In Data Exception: If our Privacy Policy mentions data sharing or selling to non-affiliated third parties, this excludes text-messaging originator opt-in data and consent. This information will not be shared with third parties.
User-Generated Content
Public posts such as product reviews may be visible to anyone.
Third-Party Websites and Links
External sites have their own privacy policies. We are not responsible for the privacy or security of those sites.
Children's Data
The Services are not intended for children, and we do not knowingly collect children's personal information.
Security and Retention
We take reasonable administrative, technical, and physical measures to protect your information, but cannot guarantee perfect security. We retain information as long as necessary for operational, legal, and service-related purposes. Financing and credit-related information is retained for the period required to meet our legal, regulatory, and contractual obligations. We maintain procedures to respond to security incidents, and where a breach of security safeguards creates a real risk of significant harm, we will notify affected individuals and the Office of the Privacy Commissioner of Canada (and other regulators) as required by law.
Your Rights
Depending on your province of residence, you may have the right to access, correct, or request deletion of your personal information, to withdraw your consent, and to request portability of certain information. Quebec residents also have rights relating to automated decision-making, including the right to be informed of, and to request review of, decisions based exclusively on automated processing. You can exercise these rights, or ask a question, by contacting our Privacy Officer. You can opt out of marketing emails or SMS at any time.
Complaints
You may contact our Privacy Officer with privacy concerns or complaints at the details below. If you are not satisfied with our response, you may have the right to contact the Office of the Privacy Commissioner of Canada, or the privacy regulator in your province. Quebec residents may also contact the Commission d'accès à l'information du Québec.
International Users and Cross-Border Storage
We, and our service providers, payment processors, and finance and lending partners, may store, access, and process your personal information outside your province of residence, including outside Canada (for example, in the United States). When information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction, including lawful access by courts, law enforcement, and government authorities. We take the steps required by applicable law, and use contractual and other safeguards with our service providers, to protect personal information that is transferred or processed outside your province or Canada.
